X-TERRA® TrySY® Field Trial Participation Agreement 2026-27

1. Welcome

Thank you for joining the Syngenta X-TERRA® Try-SY® Field Trial (“Trial”). This Participation Agreement sets out what each party agrees to do. The parties are:

  1. The Farm Business which accepts this Participation Agreement online (“you”, “your”); and
  2. Syngenta UK Ltd, reg’d co. 00849037, reg’d office: Jealott’s Hill International Research Centre, Bracknell, Berkshire, RG42 6EY (“Syngenta”, “we”).

2. About the Trial

The Trial is a comparison of a Syngenta X-TERRA® hybrid winter wheat variety against a conventional winter wheat variety of your choice, grown on your farm and harvested in the 2027 season. The aim is to produce a real-world comparison of performance under your own farming conditions.

  • We will provide a free of charge 9M seed bag of a Syngenta X-TERRA® winter wheat variety of our choice (“Trial Seed”).
  • We will arrange delivery of the Trial Seed to your specified farm location in Great Britain. Delivery will be at our cost.
  • You will select a suitable split-field site within Great Britain with low variation to give a fair comparison for the Trial.
  • You will drill both the Trial Seed and your chosen conventional winter wheat variety and manage both plots in exactly the same way — same inputs, same rates, same timing.
  • You will farm the Trial to your usual professional standard with the aim of achieving a good yield and crop quality on both plots.
  • You cover all farming costs and you retain ownership of the crop.
  • You will only use authorised crop protection products, applied in line with the product label, and you will keep full spray records with certified operators applying all products.
  • You will follow any BASIS-qualified agronomist recommendations and comply with all relevant laws and regulations. 

3. Data and Trial Monitoring

To get the most out of the Trial, we will monitor progress and collect data:

  • You agree to keep us updated on how the Trial is progressing and allow us access to the Trial field and plots at agreed, convenient times.
  • We may take photographs and video during these visits. We will own the copyright in any images or footage we create. Where images contain personal data, we will seek consent before using them publicly.
  • You will share data and results from the Trial with us via email (the “Trial Results”), which must include: 
    • the variety name of your conventional winter wheat comparator;
    • full agronomic input records (including spray records and application dates);
    • any agronomist advice received;
    • crop yield and quality data; and
    • farming operations data from your machinery.
  • You will create a CROPWISE® digital trial field variability assessment by indicating the trial field online. We will have access to this data.
    • We will monitor the Trial via our CROPWISE® digital agriculture platform.
  • You grant to us and to our group companies a royalty-free, permanent, irrevocable worldwide licence to use the Trial Results for any purpose.

4. Confidentiality 

We intend to collate and publicise Trial Results from all participating farms. To give us time to do that, you agree to the following confidentiality restrictions which apply during the Trial and for two years after harvest.

  • You agree not to share any Trial Results OR your experiences, insights or opinions about the Trial with anyone outside your Farm Business and its agronomic advisors.
    • This does not prevent you sharing Trial Results with Syngenta as set out in section 3 above.
  • This restriction does not apply to information that:
    • we have already made public, for example, via our social media, digital channels, websites or in other published marketing or promotional materials; OR
    • we have given you permission to share or publicise.

5. Testimonials and Video Content

We hope the Trial goes well and ask that a representative of your Farm Business (a “Contributor”) will provide honest feedback and testimonials about X-TERRA®, how the Trial Seed performed versus the comparator variety, including via personal appearances such as video interviews.

  • This will be done under the terms of the Contributor’s Agreement entered into by the Contributor.
  • We offer no payment to the Contributor. The free Trial Seed provided to the Farm Business is the consideration for the Contributor’s personal content. We will make this clear whenever we publicise the content. 

6. Your Personal Data

7. The X-TERRA® Trial Seed – Warranty and Risk

We are confident that the Trial Seed we provide under this Participation Agreement will perform well. Please note:

  • Risk in the Trial Seed passes to you on delivery.
    • If the distributor/courier unloads the Trial Seed at your designated delivery location, delivery takes place when the Trial Seed has been unloaded there.
    • If you unload the Trial Seed from the distributor/courier’s delivery vehicle, delivery takes place when it is made available for unloading at your designated delivery location.
  • We warrant that, at the time of delivery, the Trial Seed will comply with its product labels.
  • If you notice a visible defect, please notify us within 5 days of delivery. For non-visible defects, notify us within 5 days of discovery.
  • Notification of a defect must be given via email to customer services at seedsales.uk@syngenta.com .
  • Upon request, you will return the Trial Seed to us (at our cost) for investigation or allow our representative to visit the Trial field to investigate the issue.
  • We will replace any Trial Seed that does not meet the warranty.
  • The warranty does not apply if the Trial Seed is not used in accordance with the product labels, is stored or handled incorrectly, or the defect did not exist at delivery.
  • To the extent allowed by law, all other implied warranties are excluded.

8. Liability

Please note that:

  • Nothing in this Participation Agreement limits either party's liability for death or personal injury caused by negligence or for fraud or for any other liability that cannot lawfully be excluded or limited.
  • Subject to the above, neither party is liable for any indirect losses or for any loss of profit (whether direct or indirect).
  • For all other matters, each party's maximum liability is limited to the market value of the Trial Seed provided under this Participation Agreement.

9. Duration and Termination

  • This Participation Agreement applies from the date you indicate acceptance online and continues in force for one calendar year.
  • Either party may end this Participation Agreement immediately by written notice if the other commits a serious breach and fails to fix it within 14 days of notice.
  • We may end the Participation Agreement immediately if we reasonably consider that the Trial poses a risk to health, safety or the environment.
  • On termination, you will stop the Trial immediately.
  • Sections 3, 4, 5, 6, 7, 8, 9 and 10 of the Participation Agreement survive termination.
  • Notices of breach or termination must be sent by recorded delivery or courier to the other party's registered office.

10. General

  • You may not transfer or assign your rights under this Participation Agreement without Syngenta's prior written consent.
  • This Participation Agreement is the entire agreement between the parties regarding the Trial and replaces any prior discussions.
  • This Participation Agreement is governed by English law and the English courts have exclusive jurisdiction.
