#HOTPOTATOESUK COMPETITION 2022 TERMS & CONDITIONS

Please read these terms and conditions (“Rules”) carefully. “Competition” means Syngenta’s Hot Potatoes Competition 2022. “Syngenta” and “we/us/our” means Syngenta UK Limited, reg’d co. no. 00849037, reg’d office CPC4 Capital Park, Fulbourn, Cambridge, CB21 5XE.

1. Eligibility Requirements

1.1 The Competition is open only to growers on farms in the UK, Republic of Ireland, Isle of Man, Jersey and Guernsey (“Competition Area”) excluding employees of Syngenta and their immediate families and anyone else professionally connected with this Competition.

1.2 “Entrant” means the person submitting an Entry into the Competition. Entrants must have a Twitter account in order to participate in this Competition. Entrants must also be 18 years old or over and we reserve the right to request proof of age from any potential prize winners.

1.3 “Entry” means a photo of one or more potato plants in the sun on farmland within the Competition Area. To be valid, Entries must have been photographed between 17 June 2022 and 19 August 2022 (“Competition Period”). We reserve the right to verify the eligibility of Entries.

2. How to Enter

2.1 No fee or purchase is necessary to enter the Competition.

2.2 Twitter account. In order to submit Entries into the Competition, Entrants require a Twitter account. Twitter is the only route of entry into the Competition. No other forms of entry will be accepted. Some personal data is required by Twitter to set up an account and use of Twitter’s social media services will be subject to Twitter’s terms of service and any other applicable rules, policies, community guidelines, privacy policies, cookie policies and so on imposed by Twitter (“Twitter’s Terms”), which Syngenta has no control over. Entrants should be aware that some information about them and any photos uploaded to the Competition will be visible to people using Twitter’s services. Entrants should therefore familiarize themselves with Twitter’s Terms. Syngenta gives no warranty with respect to Twitter’s services nor with respect to any use which Twitter or other users may make of your personal data.

2.3 To the extent that there is any conflict or inconsistency between these Rules and Twitter’s Terms, the latter will prevail with regard to use of Twitter’s services only. These Rules will prevail with respect to matters relating to Syngenta’s Competition, including judging of Entries, selection of winners and award of prizes.

2.4 To enter the Competition, Entrants must post their Entries on Twitter using #hotpotatoes during the Competition Period.

2.5 Entrants may submit multiple Entries, however only one prize per Entrant will be offered.

2.6 We reserve the right to disqualify any Entry which we reasonably believe does not comply with the requirements of paragraph 1 of these Rules or which we consider to be offensive or harmful in any way. and we may ban persons submitting such photos from further participation in the Competition.

3. Judging and selection of winners

3.1 The Competition will be judged by Syngenta. At the end of the Competition Period, our judges will choose their favourite photos from the Entries submitted and select five winners.

3.2 Judging will be undertaken within one month after the Competition Period ends and we will contact the winners via Twitter.

3.3 Our decision concerning all matters relating to the Competition, including the determination of the winners, will be final and binding.

3.4 If we are unable to contact any prize winner or do not receive a reply within one month, the prize will be forfeited. At our discretion, we may select a new prize winner from the remaining Entries.

3.5 Entrants who do not win a prize will not receive any notification.

4. Prizes

4.1 There are prizes for the selected winners of a USB plug-in personal cooling fan.

4.2 There is no cash alternative and the prizes are not transferrable. In the event of unforeseen circumstances, we reserve the right to provide an alternative item of equal or greater value.

4.3 We will only post prizes to an address within the Competition Area provided by the Entrant. We accept no liability for prizes lost or damaged in the post.

4.4 The winner(s) will be responsible for any income tax or other taxes or payments due as a result of winning a prize.

5. Data protection and notifying the winners

5.1 Syngenta will use Entrants’ personal data only to administer the Competition, including notifying winners and arranging for prizes to be delivered. Syngenta’s use of Entrants’ personal data will be in accordance with our privacy policy, which is available at https://www.syngenta.co.uk/content/privacy-policy .

5.2 Entrants should refer to Twitter’s privacy notice at https://twitter.com/en/tos for information about how Twitter uses their personal data.

6. Exclusions of warranties and liability

6.1 We accept no liability for lost, late or misdirected Entries, for unavailability of Twitter’s services or Syngenta’s website or social media feeds or for technical failures of any kind or for any human error which may occur in the receipt or processing of the Entries or prizes.

6.2 We provide no warranty with respect to the prize and accept no liability for loss of or damage to the prize in transit. The winner should refer to the manufacturer in case of any issue or compliant.

6.3 We accept no liability for any damage, loss, liabilities, injury or disappointment incurred or suffered by Entrants as a result of entering the Competition, using Twitter’s services or accepting any prize.

6.4 Nothing in these Rules shall exclude our liability for death or personal injury as a result of our negligence.

7. Changes to Rules

7.1 If, due to events beyond our reasonable control, we decide to modify the Rules at any time, we will notify Entrants as soon as is practically possible.

7.2 We reserve the right to change, suspend or cancel the Competition without specifying the reasons and without incurring liability as a result.

8. General

8.1 This Competition and these Rules are governed by the laws of England and the courts of England shall have exclusive jurisdiction over any dispute.
